Texas Just Made It Faster to Start a Business — and That Changes Everything

Texas Just Made Business Move at the Speed of Lightning – For a Price

Same-day and next-day business filing is now available in Texas. Here’s what it means for entrepreneurs, investors, and anyone ready to stop waiting and start building.

If you’ve been sitting on a business idea waiting for the right moment — this might be it. The Texas Secretary of State just expanded its Texas Express expedited filing service to include business formations and out-of-state registrations, making Texas one of the fastest states in the country to get a new business officially off the ground.

Same-day filing. Next-day filing. No more waiting weeks for paperwork to clear before you can open a bank account, sign a lease, or make your first hire. Secretary of State Jane Nelson made it official: Texas is open for business — and now it means right now.

What Changed and Why It Matters

Texas Express launched in 2025 with expedited processing for amendments, mergers, and conversions. The new expansion adds the most critical filings of all — the ones that actually bring a business into existence. Certificates of Formation, out-of-state registrations, amended registrations, and reinstatements are all now eligible for same-day or next-day processing.

“The ability to act quickly, especially when starting a business, can lay the groundwork for success,” said Secretary Nelson. “Our office has created options for entrepreneurs and investors who are ready to start doing business today.”

That matters more than it might sound. Before this expansion, a business formation in Texas could take days or weeks to process through standard channels. During that waiting period, entrepreneurs couldn’t open business bank accounts, couldn’t sign commercial leases in the business name, couldn’t formally apply for financing, and couldn’t make their first hire. Every day of delay was a day of momentum lost.

What This Means for Texas Business Owners

Texas already has more than 3 million active businesses — a record — and more companies are choosing to incorporate here every year. The state’s combination of no corporate income tax, a large and growing workforce, and a regulatory environment that favors growth has made it one of the premier business destinations in the country.

The Texas Express expansion accelerates that advantage. Here’s how it changes the game for real business owners:

For the first-time entrepreneur, speed is everything in the early days. Getting formally registered means you can open a business checking account, separate your personal and business finances, and present yourself professionally to clients, landlords, and lenders. With same-day filing, that can happen the same afternoon you walk in.

For investors and venture-backed startups, timing can mean the difference between catching a funding window and missing it. A same-day formation means a deal that might have been delayed by bureaucracy can now proceed on the deal’s timeline rather than the government’s.

For out-of-state businesses expanding into Texas, amended registrations and out-of-state registrations are now eligible for the same expedited service — meaning a company headquartered in California or New York that wants to formalize its Texas presence doesn’t have to wait.

For businesses that let their registration lapse, reinstatements are also covered — giving companies a fast path back to good standing before they miss another opportunity.

How the Service Works

Both same-day and next-day services require in-person filing at the Secretary of State’s office in Austin. Filings must be received by noon to qualify for same-day processing by close of business, or next-day processing by close of the following business day.

Same-Day Service: $750 per document plus the standard document filing fee. Filing received by noon, processed by end of business the same day.

Next-Day Service: $500 per document plus the standard document filing fee. Filing received by noon, processed by close of business the next business day.

The Secretary of State strongly advises using its preclearance review service before submission to catch any errors or issues that could delay processing. Email [email protected] before sending your agent or courier so staff can anticipate your arrival and prepare accordingly.

The Bottom Line for Texas Entrepreneurs

“Formally creating a business is the first step often necessary before applying for financing, securing office space, or making the first hire,” said Secretary Nelson. “We are offering the option for Texas businesses to file as quickly as possible so they can get on with the business of business.”

That is exactly right. The paperwork has always been the starting line, not the finish line. Now the starting line is the same day you decide you’re ready.

Whether you’re launching a food truck, a tech startup, a construction company, or a retail shop, the state of Texas is making it easier than ever to make it official — and to make it official fast.

Texas Express is available in person only at the Secretary of State’s office in Austin. Standard filing fees still apply in addition to the express service fees. The preclearance review process is strongly advised before submitting time-sensitive documents.

Services now available through Texas Express: Certificate of Formation, out-of-state registrations, amended registrations, and reinstatements — in addition to previously available services including certificates of conversion, mergers, amendments, restated formations, and certificates of validation for domestic entities.
